INFORMATION COLLECTION AND USE.
Personally Identifiable Information.
Anyone can access our Websites, but there are certain areas and services that require registration or provision of certain personal information if accessed, such as by way of example: entering premium content areas, placing advertisements online and making other online purchases, signing up for email newsletters, promotions, contests, sweepstakes or special offers, or participating in reader forums, message boards, chats and reader surveys. If you choose to make a purchase or use such areas, we will ask for certain personally identifiable information, which may include name, mailing address, valid email address and other personal information. Based upon the personally identifiable information you provide us at registration, we will send you a welcoming email to verify your username and password. We will also communicate with you in response to your inquiries, to provide the services you request, and to manage your “account.” We will communicate with you by email or as otherwise directed by you.
If you purchase a product or service from us, or through us, we request certain personally identifiable information from you on our order form. You must provide contact information and billing information (such as credit card number, expiration date.) We use this information for billing purposes and to fill your orders. If we have trouble processing an order, we will use this information to contact you.
Certain information supplied by you to our Websites may be password-protected, and you should take appropriate measures to protect the secrecy of your password. If you use a computer in a public place or share a computer with others, remember to sign out and close your browser window when you finish accessing our Website in order to prevent others from accessing your personal information. You are solely responsible for the control and use of each password you create.
Personal information which you provide on any open forum, such as comments on stories, blog posts or in the forum section of the site, or in other areas that are accessible to other users could be collected and disclosed by others. We cannot take any responsibility for such collection or disclosure.
We may disclose information you have provided to us if we have a good faith belief that such disclosure is necessary to: (1) comply with the law, government action or with legal process served on us; (2) protect and defend our rights or property, including without limitation these Websites; or (3) protect the personal safety or property of our users or the public (by way of example, if you provide false information or pretend to be someone else, information about you may be disclosed as part of an investigation).
In the event of a change of control of The Batavian or any of its subsidiaries (such as through a merger or sale of equity) or in the event of a direct or indirect sale of any Website through a sale of assets, liquidation or other transaction, any personal information of users of the affected Websites in our possession will be transferred to the new company as part of the transaction. We are not obligated to notify Website users of any such transaction.
If we gather demographic information from you (for example, your age, education level or household income), we will not share that information in a manner that identifies you as an individual with any other third party, unless we let you know that at the time of collection and you consent by providing the information. When we share demographic information with third parties, we will give them aggregate information only, unless you have consented otherwise, or unless otherwise required by law, government action or legal process served on us.
We may also collect other information from users to the Websites such as the user’s IP address (the number assigned automatically to your computer whenever you use the World Wide Web), length of time spent on the Websites, and the pages accessed during each visit to the Websites. We use this information to analyze trends, administer the site, track user’s movement, and gather broad demographic information for aggregate use.
We do have the ability to connect a users IP address to a specific post and through that post trace the IP address to a specific user. As a general practice we do not use IP addresses in this manner, but reserve the right to use IP addresses to check on user identity when investigating specific and suspected breaches of the Terms of Service.
HOW DO I OPT OUT OR CHANGE MY PERSONAL INFORMATION
As a general practice, we do not delete accounts even upon request. Upon request, we will block access to an account, but the name of account holders and content posted (such as comments and blog posts) will remain accessible as a matter of ethical transparency. The Batavian has no obligation to delete content once created, and because of the ethical need to keep available content once created, user accounts are almost never deleted since that would also delete content created by that user.
CHILDREN’S ON-LINE PRIVACY INFORMATION
OUR COMMITMENT TO DATA SECURITY
We have put in place security procedures reasonably designed to safeguard and secure the information under our control, and we follow generally accepted industry standards.
Although we will exercise reasonable care in providing secure transmission of information between your computer and our servers and in storing that information on our systems, no method of transmission over the Internet, or of electronic storage, is 100% secure. So we cannot ensure or guarantee the security of any information transmitted to us over the Internet.
When you enter sensitive information (such as credit card numbers) on our forms, we encrypt, or instruct our providers to encrypt, that information using secure socket layer technology (SSL).
